Terms of Use
At a glance
- NOOFA gives one specific physical object a lasting Object Profile. A profile can stay Private indefinitely; making it Public is optional.
- Saving information or selecting “Include in public profile” does not publish it.
- Before first publication, the Profile Holder sees the exact proposed Public profile and deliberately chooses Make public.
- A Public profile can appear in Browse and Find. Public material may be indexed, linked, cached, copied, quoted or screenshotted by others.
- Where the feature is available, you may include a full Object Identifier in the Public profile. After you preview and deliberately publish it, people can use that public Identifier for an exact search in NOOFA Find. There is no separate searchable switch.
- Later private edits do not change the live Public profile until the holder previews the replacement and chooses Update public profile.
- Make private stops NOOFA’s own active public delivery and removes NOOFA-controlled public image copies, but cannot recall independent external copies already made while material was Public.
- Changing, deselecting or removing an Identifier privately does not change its already-published copy. Update public profile applies the change; Make private or an authorised urgent restriction can end public delivery sooner.
- Profile Control and the holder’s private relationship declaration are not proof of ownership, authenticity, provenance, condition, value or right to sell.
- NOOFA is not a marketplace, registry, certificate, ownership service or transaction service.
1. About these Terms
These Terms are between you and John Kennedy, a sole trader trading as NOOFA (“NOOFA”, “we”, “us” or “our”). Our geographic correspondence address is 88–90 Hatton Garden, London, United Kingdom, EC1N 8PG. You can contact us at tkmax@mac.com.
These Terms apply when you affirmatively accept Terms v4.0 through the NOOFA Account policy flow. Before acceptance, NOOFA will show or link to the complete Terms, identify the policy version and effective date, and make the text available to keep. NOOFA records your affirmative acceptance. Reading or acknowledging the Privacy Notice is separate and is not agreement to every use of personal information.
Public pages may be viewed without an Account. Protected Account and Profile Holder functions require an invited, complete Account unless NOOFA later changes admission through a separately governed release.
2. Who may use NOOFA
You must be at least 18 years old and have a valid NOOFA invitation to hold an Account during the controlled phase. Your invitation and Account are personal to you unless NOOFA expressly agrees otherwise.
You must provide accurate information, use an email address you control, protect your sign-in details and tell NOOFA promptly if you think someone else has used your Account. You must be legally able to enter into this agreement.
The controlled phase is intended for personal use. Business, institutional, professional or contributor Accounts require a later controlled decision and may require different terms.
3. Accounts and security
- Keep your sign-in details secure and do not share invitation, recovery, access or refresh tokens.
- Use NOOFA’s recovery route if you lose access and sign out from devices you no longer control.
- Do not try to access another person’s Account, Private Object Profile, Profile Control relationship, Follow relationship, private media, record-reference support or restricted information.
- NOOFA may require re-authentication, email verification, Account completion or a current policy update where reasonably necessary for security, contract formation or protected use.
- Email verification confirms control of an email address only; it does not verify any fact about an object.
4. What the service provides
When the relevant service functions are available for your Account, you may create and maintain a Private Object Profile, add private content and images, use private stewardship and Preview functions, and, where public-profile publishing is available for your Account, prepare and deliberately make an eligible profile Public.
Private use is complete. You do not have to publish a profile, build an audience, prepare for a sale or fill every available field.
NOOFA may introduce, change, limit or withdraw controlled-preview functions. Functions described as future or not yet available are not promised by these Terms.
Public Object Identifier functions may remain unavailable until NOOFA separately releases them. These Terms do not themselves switch on the feature or publish any existing Identifier. Private Identifier use remains available within the functions authorised for your Account.
5. Object Profiles, Profile Holders and Profile Control
One Object Profile represents one specific physical object. The NOOFA Profile Reference identifies the NOOFA profile. It is not a title record, certificate, authenticity record, ownership identifier or official object identifier.
Profile Control is the authority within NOOFA to manage one Object Profile. It is private and profile-specific. It does not prove or confirm ownership, legal title, possession, permission, authenticity, provenance, history, condition, value, availability or a right to sell. Public presentation, Browse/Find inclusion or later editorial curation do not change that boundary.
An Object Identifier is a number, code or marking that a holder records to distinguish the physical object, such as a car Registration, VIN or Chassis number, a Wristwatch Serial, Case or Movement number, or a Guitar Serial number. It is distinct from the permanent NOOFA Profile Reference. Recording, formatting, displaying or finding an Identifier does not confirm that it is correct, assigned to the object, unique, authentic, legally held or absent from a theft or loss record.
6. Your relationship to the object
Before first publication, NOOFA may require a private self-declaration about your connection to the object. The response is used for integrity, misuse deterrence and accountability. It remains private and is not a badge, certificate or verification result.
If you say that you are creating or managing a profile for another person or organisation, you must have their permission to do so and to provide the content you add. The represented person or organisation may contact NOOFA at tkmax@mac.com to challenge Profile Control or content. If NOOFA later allows non-founder publication, this permission requirement applies before that publication is allowed.
Do not put sensitive personal information or another person’s name into the free-text relationship field unless genuinely necessary.
7. Private and Public information
A new Object Profile begins Private. Ordinary Save always remains private. “Include in public profile” records material you want considered for the next deliberate Public version; it does not itself publish anything.
Before first publication, NOOFA assembles the exact proposed Public profile. If the current objective requirements are met, you may deliberately choose Make public. If the profile is already Public, later private edits remain private until you preview the proposed replacement and choose Update public profile.
Private originals, private record-reference support, follower information, reports, moderation information, audit information, exact location and sensitive identifiers do not become Public merely because they exist in NOOFA.
7.1 Object Identifiers: a separate public choice
An Object Identifier starts private. You may select each eligible Identifier individually using “Include in public profile”. This records your instruction for the next proposed Public profile; it does not make the Identifier public or searchable. No separate search switch applies.
When the feature is available, the exact Public preview shows the full selected Identifier, its label and any necessary context. It does not partially mask the number. A Registration needs the supported issuing-country or system information before it can be included. Where the supported Identifier type permits it, a previous Identifier may be selected independently and shown as Previous. Historical information is never selected merely because it exists.
Keeping an Identifier private does not make a profile incomplete or prevent publication of an otherwise eligible profile. The private Identifier source, its audit records and your Account identity do not become public with the published value.
8. Your content and the licence you grant
You keep ownership of content you own. You grant NOOFA a non-exclusive, worldwide, royalty-free licence for as long as reasonably needed to operate the service: to host, store, reproduce, technically process, resize, reformat, display and deliver your content; to create access-controlled preview copies; and, when you deliberately publish, to create and deliver separate public copies with the Public profile.
The licence also permits proportionate technical changes needed for security, accessibility, responsive delivery and file-format compatibility. NOOFA does not acquire title to your content and does not require a blanket waiver of moral rights. Where attribution is required, NOOFA will use the governed credit information available to it.
You must have the rights, permissions and lawful basis needed for the content you add. If your content includes another person, their image, personal information or third-party material, you are responsible for using it lawfully and for responding honestly to any rights challenge.
Before making an Identifier public, consider whether it could identify or expose information about another person, including a current or previous keeper, owner or person for whom you manage the object. Use a lawful and proportionate reason for sharing it and respect confidentiality and any permissions that apply. NOOFA does not require you to prove legal ownership merely to record an Identifier, but Profile Control alone is not permission to disclose another person’s information.
A vehicle Registration, especially when combined with other information, can relate to an identifiable person. Do not combine published Identifiers with home or storage addresses, access details, sensitive routines or unnecessary identifying information. Your responsibilities do not remove NOOFA’s own data-protection obligations.
9. Images and public media
Private image originals remain access-controlled. NOOFA may create resized and reformatted derivatives so it can provide responsive display, accessibility, security and public-profile preparation.
Before publication, prepared derivatives remain access-controlled. NOOFA may use short-lived authorised delivery so you can see the exact proposed Public profile. Those prepared copies are not made anonymously public merely because they exist.
When you deliberately Make public or Update public profile, NOOFA may copy the exact approved prepared derivatives into separate public-delivery storage and serve those copies with the Public profile. Public copies can be cached by ordinary web infrastructure and may be copied by third parties.
NOOFA may remove embedded metadata, including location and device information, from copies used for preview or public delivery. Do not include a home address, storage location, access code, precise routine or other information that could create a safety or security risk for a person or object.
10. Making an Object Profile Public
Make public is a deliberate action. Before it is available, NOOFA re-checks current Account and Profile Control authority, current policy status, the private relationship response, the profile state, objective readiness, image rights/source information, public-media preparation and applicable safety restrictions.
The checks are objective. They are not an editorial judgement about whether an object is interesting, prestigious, expensive, rare or beautifully presented.
When you choose Make public, the selected public-safe material becomes available to anyone through the Public Object Profile. The profile may appear in ordinary Browse and Find. Public material may be indexed, linked, cached, copied, quoted, downloaded or screenshotted by other people or services.
Publication does not mean NOOFA has verified ownership, permission, authenticity, provenance, history, condition or value. Public availability is not certification or endorsement.
When you deliberately Make public or Update public profile, the selected eligible Object Identifiers shown in the exact preview are displayed in full and become available for exact retrieval through NOOFA Find as part of that Public version. This may include an individually selected Previous Identifier where supported. Public Identifier availability is not an ownership, authenticity, provenance, legal-title, registration-entitlement, uniqueness or theft-status check.
11. Public-profile changes and content removal
The private source remains editable while the profile is Public. Saving a private change does not alter the live Public profile. The last successfully activated Public version remains live until you deliberately preview and apply a replacement or NOOFA lawfully restricts the profile.
A proposed update may add, change or remove selected public text, Details, Object Identifiers, continuity entries or images. Turning “Include in public profile” off keeps the material privately saved and removes it from the live Public profile only after a successful Update public profile action.
The service is designed so a failed update does not intentionally replace the last valid Public version. This is not a promise of uninterrupted availability where legal, safety, security or provider issues require restriction.
The same rule applies when you correct, deselect or remove an Identifier privately: the old public value and its exact Find match remain until a successful Update public profile applies the replacement. An Identifier removed privately is not automatically erased from an already-active Public version. The review must show what will remain, change or disappear.
When an Identifier genuinely changes, its previous record and the new current record are separate. The replacement begins unselected, and a prior selection of the old current value does not automatically select it for publication as Previous. Select either eligible record deliberately before the next public update.
To stop NOOFA public delivery sooner, use Make private or contact NOOFA about an urgent privacy, legal or safety concern. Statutory rights and authorised urgent restriction are not delayed until another holder chooses to update. Restricted audit or legal records may remain where justified, as explained in the Privacy Notice.
12. Making an Object Profile Private and Public again
A Profile Holder may choose Make private. NOOFA then stops its own active public delivery, removes the profile from its active public route, Browse and Find, removes any NOOFA editorial placement, and removes NOOFA-controlled public-delivery image copies according to the governed withdrawal process.
Making a profile Private also ends its active public Identifier display and its Identifier matches in NOOFA Find. The privately retained records do not become search results. Independent copies already made outside NOOFA cannot be recalled by that action.
The Private Object Profile, Profile Reference, private originals, valid restricted prepared derivatives and stewardship history remain. Make private is not Archive, deletion or Account closure.
NOOFA cannot guarantee removal from search-engine indexes, browser or third-party caches, screenshots, quotations, downloads, archives or independent copies created while the profile was Public. A previously Public profile can later use the ordinary Make public journey again.
13. Browse, Find and editorial curation
Every qualifying active Public Object Profile may appear in ordinary Browse and Find under current objective category, projection and safety rules. There is no separate ordinary holder request or subjective editorial approval for Browse or Find inclusion.
NOOFA may organise, index, order, filter and present Public profiles to operate the service. Payment, follower activity, object value or holder preference cannot buy publication, ordinary Browse/Find inclusion or editorial prominence.
NOOFA may later choose already-Public profiles for an approved Homepage or curated surface. Curation is positive editorial selection and does not affect whether a profile is Public or ordinarily discoverable.
Find can retrieve an active Public profile using its complete NOOFA Reference, ordinary supported object wording, or a full public Object Identifier. Identifier matching uses the whole submitted value after conservative, type-appropriate formatting normalisation. It is not a fuzzy, partial, prefix, wildcard, range or autocomplete Identifier search.
A single unambiguous public Identifier match can open its Public profile directly. More than one Public profile can share a value; a collision list uses only already-public context to help you choose. A result does not establish uniqueness or correctness. A no-match result does not disclose whether NOOFA holds a matching private, unselected or not-yet-published record.
NOOFA may limit exact-Identifier requests to protect people and the service. It provides no bulk Identifier register or Identifier browse facet. NOOFA’s exact-match rules do not control how third parties search, index or copy material once it has been deliberately made public.
14. Reports, moderation, rights and safety
NOOFA may receive privacy, copyright, image-rights, data-protection, defamation, safety, security or other legal complaints at tkmax@mac.com during the controlled phase. Where a public reporting route exists, it may also accept profile/content reports there.
NOOFA may restrict, preserve, remove or make content unavailable where reasonably necessary to comply with law, protect privacy or intellectual-property rights, address fraud or abuse, protect object/location security, investigate a credible report, protect users/providers, or comply with applicable online-safety duties.
Where practicable and lawful, NOOFA will explain the effect of a restriction and any available route to challenge it. Urgent legal or safety action may occur before notice. Before NOOFA allows non-founder holder publication, it will put in place the additional public reporting, complaints and moderation controls required for that release.
You may report an incorrect Identifier, a possible misuse of a number associated with your object, a personal-information concern or an object-security risk. A complaint does not itself prove ownership or entitle a person to Profile Control. NOOFA will assess the concern proportionately and may restrict public display and exact retrieval while addressing an urgent risk or a legal obligation.
15. Acceptable use
- Use NOOFA lawfully and do not impersonate another person or misrepresent your connection to an Account, object or profile.
- Do not claim that Profile Control, publication, Browse/Find or curation proves ownership, authenticity, provenance, condition, value or permission.
- Do not add content or images you do not have the right or lawful basis to use.
- Do not add unnecessary special-category, criminal-offence, confidential or other sensitive personal information.
- Do not add unlawful threats, harassment, hate, exploitation, intimate-image abuse, child sexual abuse material, terrorism content or other unlawful material.
- Do not bypass access controls, policy gates, security checks, rate limits or public-media controls.
- Do not access or interfere with another person’s Account, private content or systems without permission.
- Do not introduce malware, automated attacks or denial-of-service activity.
- Do not use NOOFA to create a marketplace, buyer list, seller-contact route, public popularity system or social feed.
- Do not disclose precise locations, access details or routines that create a foreseeable security risk for a person or valuable object.
Do not fabricate an Identifier association, present NOOFA as an official register or stolen-object check, harvest Identifier records in bulk, or circumvent exact-search limits or safeguards.
16. NOOFA intellectual property
NOOFA and its licensors own the service, software, interface, design system, trade marks, wordmark and original NOOFA material. These Terms do not transfer those rights to you. You may use the service only through the functions provided, subject to any rights the law gives you.
17. Third-party material and links
Object Profiles may refer to third-party sources, publications, events, photographs, websites or people. A reference, link, credit or public appearance does not mean NOOFA verifies or endorses the third party, object, information, service or transaction. You are responsible for appropriate attribution and lawful use of third-party material you add.
18. Changes, availability and security
NOOFA is a controlled invitation-only service unless a later release authority states otherwise. We aim to provide the service with reasonable care, but we do not promise uninterrupted or error-free availability. Maintenance, security events, provider outages, legal restrictions and controlled testing may affect availability.
We may process technical information and remove embedded image metadata to protect users, objects and the service. We may change technical delivery, providers or non-material features where this does not unfairly remove agreed core rights. Material changes to the contract are handled under section 22.
19. Restriction, suspension and termination
Where reasonably possible, NOOFA will use a proportionate response: warning or correction opportunity, temporary restriction, content/profile restriction, Account suspension, or termination. The response depends on seriousness, urgency, repeat behaviour, legal duties and security risk.
NOOFA may act immediately where necessary to prevent harm, protect security, preserve evidence, comply with law or address serious abuse. Where practicable and lawful, we will explain the action and any available review route.
20. Closing your Account and profile consequences
You may ask to close your Account through the governed support/contact route. NOOFA will explain the consequences for Profile Control, Private profiles, Public profiles, Following and retained legal/audit records before completing closure where practicable.
Account closure must not trap an Object Profile in Public state. NOOFA must preserve a route to reduce public exposure, including Make private where the authenticated holder still has valid Profile Control, even if a policy update is outstanding.
21. Our responsibility to you
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of rights that cannot lawfully be excluded, or any other liability that the law does not allow us to limit.
If NOOFA fails to comply with these Terms, we are responsible for loss or damage that was a foreseeable result when you accepted them. If you use NOOFA as a consumer, we are not responsible for business losses such as loss of profit, revenue, business opportunity or business interruption.
Subject to the non-excludable liabilities above, NOOFA’s total liability arising from the service will be limited to the greater of £100 and the fees you paid to NOOFA in the preceding 12 months. This limit applies only so far as it is fair and lawful under applicable consumer law.
22. Changes to these Terms
NOOFA may update these Terms when the service, law, operator, rights or material product scope changes. A material update uses a new controlled policy version, a prospective effective date and appropriate notice. Where fresh acceptance is required, NOOFA will not treat silence, login, private Save or continued use as acceptance.
A technical, formatting, accessibility or genuinely non-material correction may be handled under the Policy Version Register without requiring fresh acceptance where the substance has not changed.
23. Governing law and disputes
These Terms are governed by the law of England and Wales, but this does not remove any mandatory consumer protection that applies where you live. If you live in the United Kingdom, you may bring proceedings in the courts of the part of the United Kingdom in which you live. You may also have other rights to bring a claim in another competent court.
Please contact NOOFA at tkmax@mac.com first if you can, so we can try to resolve the issue. This does not restrict your right to contact a regulator, use another lawful complaint route or bring proceedings.
24. Contact and complaints
Operator: John Kennedy, a sole trader trading as NOOFA.
Correspondence address: 88–90 Hatton Garden, London, United Kingdom, EC1N 8PG.
Electronic contact for Terms, support, privacy/rights and controlled-phase complaints: tkmax@mac.com. One monitored inbox may serve these functions during the controlled phase, provided NOOFA triages requests appropriately.
Do not send passwords, recovery links, invitation links, access tokens or refresh tokens by email.
People without an Account may use the contact details above to raise a privacy or Identifier concern. Describe the profile or issue and provide only the information reasonably needed to investigate; do not send identity or ownership documents unless requested through an appropriate secure process.
For data-protection complaints, NOOFA will acknowledge receipt within 30 days, make appropriate enquiries, keep you informed and communicate the outcome without undue delay. This complaints process does not limit statutory information rights or your right to complain to the ICO.
